1. Business-to-Business Services
NexGen provides its services primarily for commercial and business purposes. Our services are not intended for personal, family, or household use. Individuals interacting with NexGen on behalf of a company or other organization represent that they are authorized to act for that organization.
2. Information We Collect
Depending on how you interact with NexGen, we may collect information including:
- Name, business name, job title, email address, and telephone number.
- Account, subscription, billing, and transaction information.
- Information submitted through website forms, inquiries, support requests, or communications.
- Business contact, lead, prospect, customer, and CRM information provided or uploaded by clients.
- Campaign, messaging, appointment, pipeline, communication, and automation data.
- Technical information such as IP address, browser type, device information, log data, cookies, and usage information.
- Information generated through interactions with AI-powered features and automated systems.
- Information received from integrations, service providers, and other third-party services authorized or utilized by our clients.
3. How We Use Information
We may use information to:
- Provide, operate, maintain, configure, and improve NexGen services.
- Create and administer accounts and subscriptions.
- Process transactions and provide customer support.
- Operate CRM, messaging, automation, AI, appointment, lead-management, and related functionality.
- Communicate regarding accounts, services, inquiries, updates, promotions, and support.
- Detect fraud, abuse, security threats, or violations of our Terms of Service.
- Comply with legal, regulatory, carrier, and platform requirements.
- Develop analytics, performance measurements, research, system improvements, and new technology.
4. Client Data
Clients may provide, import, upload, transmit, or otherwise make business data available through NexGen systems. As between NexGen and the client, the client retains its rights in the underlying client-provided data, subject to the rights necessary for NexGen to provide and operate its services.
Clients authorize NexGen and its service providers to host, process, transmit, organize, format, analyze, and otherwise use client-provided data as reasonably necessary to provide, maintain, secure, support, and improve the services.
5. Aggregated and De-Identified Information
NexGen may create and use aggregated, statistical, and de-identified information derived from operation of the services where such information does not reasonably identify an individual or identify a client as the source.
NexGen may use such information for analytics, benchmarking, research, security, product development, artificial intelligence and automation improvements, performance optimization, system development, business intelligence, and the creation or improvement of proprietary technology, methodologies, know-how, and intellectual property, including following termination of a client relationship.
6. Third-Party Data and Service Providers
NexGen may integrate with, recommend, facilitate access to, or provide links to independent third-party services, including data providers, communications providers, payment processors, hosting providers, analytics providers, and other technology platforms.
NexGen may receive referral, affiliate, or other compensation from certain third-party providers. A client's decision to purchase or use a third-party product or dataset is the client's own decision and transaction with that provider.
Assistance by NexGen with formatting, cleaning, deduplicating, organizing, uploading, importing, segmenting, configuring, or otherwise processing client-provided or third-party data does not make NexGen the purchaser or original source of that data and does not transfer the client's compliance responsibilities to NexGen.
7. SMS and Mobile Messaging Privacy
Where a person provides consent to receive text messages from NexGen, we may use the provided mobile number to deliver the categories of messages for which consent was provided. Message frequency may vary. Message and data rates may apply. Reply STOP to opt out and HELP for assistance.
Consent to receive marketing or promotional text messages is not a condition of purchasing goods or services.
Information may nevertheless be disclosed to service providers acting on our behalf when reasonably necessary to provide messaging infrastructure and related services, subject to appropriate restrictions and applicable law.
8. Email Communications
We may send service-related or commercial email communications as permitted by applicable law. Recipients may use the unsubscribe mechanism provided in applicable marketing emails to opt out of future promotional email communications. Transactional or account-related communications may continue where necessary to provide requested services or administer an account.
9. Cookies, Analytics, and Similar Technologies
NexGen and its service providers may use cookies, pixels, analytics tools, log files, and similar technologies to operate the website, remember preferences, understand website and service usage, measure performance, maintain security, and improve our services.
Browser settings may permit users to restrict certain cookies, although doing so may affect website or service functionality.
10. Artificial Intelligence and Automated Systems
NexGen services may process information through artificial intelligence, machine learning, automated workflows, and other automated technologies. These systems may assist with communications, lead management, appointment scheduling, analysis, automation, customer interaction, and related business functions.
AI-generated information may contain inaccuracies or unexpected results. Clients remain responsible for determining whether outputs are appropriate for their business and for reviewing material decisions or communications where appropriate.
11. How We Disclose Information
We may disclose information:
- To vendors and service providers that perform services on our behalf.
- To integrations or third-party services authorized by the client.
- When reasonably necessary to protect NexGen, our clients, users, systems, rights, or property.
- To comply with applicable law, legal process, court orders, or governmental requests.
- In connection with a merger, financing, acquisition, reorganization, sale of assets, or similar business transaction, subject to applicable law.
- With consent or at the direction of the applicable client or individual.
Nothing in this section permits the sale or sharing of SMS opt-in information for third-party marketing contrary to the SMS protections stated above.
12. Data Security
NexGen uses reasonable administrative, technical, and organizational safeguards designed to protect information. However, no internet transmission, electronic storage system, software platform, or security measure can guarantee absolute security.
Clients are responsible for maintaining the confidentiality and security of their credentials, accounts, users, devices, and integrations.
13. Data Retention
We may retain information for as long as reasonably necessary to provide the services, administer accounts, maintain business and compliance records, resolve disputes, enforce agreements, protect our systems, satisfy legal obligations, and pursue legitimate business purposes.
Aggregated or de-identified information that no longer reasonably identifies an individual or client may be retained and used as described in this Policy.
14. Privacy Rights and Requests
Depending on applicable law and jurisdiction, individuals may have rights relating to access, correction, deletion, or other treatment of personal information.
Requests may be submitted to [email protected]. We may need to verify identity and authority before processing a request. Certain information may be retained where permitted or required by law.
Where NexGen processes personal information solely on behalf of a business client, a request may need to be directed to that client as the organization controlling the information.
15. Children's Privacy
NexGen's services are designed for businesses and are not directed to children. We do not knowingly offer our services for use by children.
16. Third-Party Websites and Integrations
Our services may contain links to or integrations with third-party websites and services. Their privacy practices are governed by their own policies. NexGen is not responsible for the privacy practices of independent third parties.
17. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our services, business practices, technology, or applicable requirements. The revised policy will be posted with an updated effective date.
