SMS Terms & Consent
1. Separate Types of SMS Consent
NexGen may request separate consent for different categories of text messaging. Consent to one category does not automatically constitute consent to another category.
Transactional / Non-Marketing Messages
Transactional or non-marketing messages may include communications relating to inquiries, appointments, confirmations, services requested, account activity, service updates, customer care, and other communications connected to an existing request, transaction, or business relationship.
Marketing & Promotional Messages
Marketing or promotional messages may include special offers, promotions, discounts, product or service announcements, business updates, and other marketing communications from NexGen.
2. Consent Is Voluntary
Where consent is requested through an online form, the applicable SMS consent checkbox is intended to remain unchecked unless the person affirmatively selects it.
3. Message Frequency
Message frequency may vary based on the individual's interactions with NexGen, the services requested, account activity, ongoing conversations, appointment status, or promotional campaigns for which consent has been provided.
NexGen does not guarantee a fixed number of messages during any particular period.
4. Message & Data Rates
Standard message and data rates may apply depending on the recipient's mobile carrier and wireless service plan. NexGen is not responsible for charges imposed by a mobile carrier or telecommunications provider.
5. How to Opt Out
NexGen will process opt-out requests in accordance with applicable requirements. After an opt-out request is received, you may receive a confirmation message acknowledging that the request has been processed.
Where required by applicable law, NexGen will also honor other reasonable methods of revoking consent.

7. Mobile Number Ownership & Accuracy
By providing a mobile telephone number, you represent that the number provided is accurate and that you are authorized to provide consent for communications to that number.
If a mobile number is reassigned, transferred, disconnected, or no longer belongs to you, you should notify NexGen or opt out so that our records can be updated.
8. Mobile Information & SMS Consent Privacy
SMS consent is specific to the party to whom the consent was provided. Consent provided to NexGen is not transferred to another business for that business's independent marketing.
NexGen may disclose mobile information to telecommunications, technology, hosting, messaging, and other service providers acting on NexGen's behalf when reasonably necessary to operate or deliver the messaging service, subject to applicable contractual and legal restrictions.
9. Automated Messaging
NexGen may use automated technology, workflows, artificial intelligence, messaging platforms, or other software to assist in sending, receiving, routing, responding to, and managing text communications.
Use of automated technology does not eliminate any consent, opt-out, or privacy requirements applicable to NexGen.
10. Carrier & Network Availability
Text message delivery is subject to the availability and operation of mobile carriers, telecommunications networks, messaging providers, devices, and other third-party systems outside NexGen's control.
NexGen does not guarantee that any particular text message will be delivered, received, or delivered within a specific time.
11. Supported Carriers
Messaging availability may vary by carrier, telephone number type, device, geographic area, and service provider. Mobile carriers are not liable for delayed or undelivered messages.
12. Consent Records
NexGen may maintain records relating to SMS consent, including the telephone number provided, date and time of consent, method of consent, form or source through which consent was provided, applicable consent language, opt-out activity, and related records where reasonably necessary for compliance, security, dispute resolution, and business administration.
13. Changes to SMS Preferences
A person may withdraw marketing SMS consent without necessarily terminating other services or business relationships with NexGen.
Where legally permitted, service-related or non-promotional communications may be handled separately from marketing preferences, depending on the nature of the communication and the applicable consent or business relationship.
